These terms govern the use of VMflow (web application and iOS app) by commercial vending machine operators.
1. Scope
VMflow is offered exclusively to businesses (Unternehmer within the meaning of § 14 of the German Civil Code). The provider is Kerl Handel GmbH (see imprint).
2. Service
VMflow provides features for managing vending machines, in particular sales analytics, stock and warehouse management, device management and a cash book. Scope and features may evolve as the product develops, to the extent reasonable for you.
3. Account and obligations
You must keep your credentials confidential and must not misuse the platform. You are responsible for the content and data your company enters.
4. Availability
We aim for high availability but do not owe a specific uptime. Maintenance may cause temporary restrictions.
5. Liability
We are liable without limitation for intent and gross negligence and under the German Product Liability Act. For simple negligence we are liable only for damage resulting from the breach of essential contractual obligations, limited to the damage typically foreseeable for this kind of contract.
6. Final provisions
German law applies. Where permissible, the place of jurisdiction is the provider's registered office. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
